(25.5.18) 生活保護を拒絶して自殺をすることは罪か？ 札幌の承諾殺人 To commit suicide reject the welfare 、is it crime? Consent murder of Sapporo

  思わず泣いてしまった。
札幌地裁での承諾殺人罪の判決の内容に「こんな悲しく、心を揺さぶることがあっていいのだろうか」と思ったからだ。
被告の大沢久美子さんは４２歳の独身女性で、母親と二人で住んでいたが母親が脳腫瘍と白内障を患い、本人も仕事を継続して続けられず、０６年９月に生活保護を受給するようになったという。

　このあたりまではよくあるケースだが、この親子は「お金だけもらうのは心苦しい」と１１年４月に生活保護の受給を辞退した。
その後は生活保護でためていた１００万円で食いつないできたが、１年後の１２年５月にはその貯金も底をつき、アパートの家賃も支払えなくなり、二人して自殺をすることを決心したという。

注）現在生活保護費は暴力団等によって食い物にされており、本当に必要な人のところには届かないという、ひどい矛盾が存在している。そのことは以下に記載しておいた。

　母親が「もう、おしまいにしよう」と自殺をすることを提案し、二人して絶食をして自殺を図ったが（食べ物がないから絶食せざる得なかったのだが）、とても死にきれず親戚にお金を無心し、その費用で練炭を購入して練炭自殺を図り母親だけが死亡したという。
久美子さんはなおも自殺をしようとして絶食していたところを管理会社の職員によって発見され、承諾殺人罪で起訴されていたものだ。

注）私もかつて人間はどこまで絶食可能かとのテストをしてみたが４日目には腹ペコになってしまった。

　しかしこれが本当に罪になるのだろうかと思う。生活保護を拒絶し、社会に一切迷惑をかけずに敢然と死を選ぶなどということは、普通の人のできることではない。
キリスト教の世界では自殺は罪だが、日本では自死は立派な自己表現で、三島由紀夫などは自衛隊の駐屯地で切腹している。

　母親の「もう、おしまいにしよう」という言葉は悲しいが、その決意は素晴らしい。
私などは人生に未練をもってめんめんと生きながらえているが、人生のある時点でこの親子のような決断ができるかどうか怪しい。
「胃ろうでもなんでもやって、生きながらせてくれ」なんて言って醜態を演じるのではないかと危惧している。

　
　「お金だけ、もらうのは心苦しい」という精神は、日本人の精神の中で最高の精神に位置する。社会に対して相応の貢献がなければその見返りは求めない精神だ。
かつて日下公人氏が「日本人ほどすぐれた民族はいない。浮浪者でも橋の下で静かに暮らし、食べ物がなくなれば黙って死んでいく。これほどほかに迷惑をかけずに生きている民族はない」と言っていたが、今回の親子の自殺を見てその通りだと思ってしまった。

　裁判長も思わず心を打たれたのだろう。執行猶予つきの判決を下し、「困ったら周囲に相談することも必要。生活を立て直して母の分もしっかり生きるように」と諭していた。
法的には承諾殺人になるが、本当はこれは裁判で裁く性質ではないと私は思う。
社会に迷惑をかけずに敢然と生命を経つという行為は、まさに葉隠れの精神でこの母親と久美子さんは、昔でいえば「本当の武士」として称賛されてしかるべきものだ。

　私は泣いてしまったが、それはその精神の崇高さに心を打たれたからで、ほとんど社会の底辺に住んでいる人でさえ、このような偉大な精神を持っている。そのことを知れば日本人であることを誇りに思い、そして涙なしにはいられなかった。
